On June 5, 2017, World Environment Day, the Hunan Provincial High Court reported nine typical cases of judicial protection of environmental resources. Qiu Shengshuang’s crimes against environmental pollution (hereinafter referred to as “Xinsheng Double Caseâ€) ranked first, and the media called it Hunan. "The first case of illegal disposal of medical waste."
As the president of the Criminal Court of the People’s Court of Miluo City, Zou satisfactorily tried this case. The 12 accused were all guilty of environmental pollution and were sentenced to criminal detention ranging from one month to three months. The core fact of the case is the illegal sale or processing of infusion bags mixed with infectious waste.
The Hunan Higher People’s Court summarized the typical significance of the case as “fully embodying the majesty and deterrent effect of punishment†and “exposing the loopholes in the management and disposal of medical wastes by medical and health institutions and the collection and disposal of medical wastes by environmental protection administrations. The supervision and management of multiple links is absent."
As a result, a long-standing “hidden rule†in the field of medical waste collection and disposal has been unveiled – driven by interests, a network of outlets spread across the country; infusion bags used extensively by medical institutions, and infectious medical care The wastes are mixed together, and after processing, some eventually become daily necessities including tableware.
It is understood that the cracking and investigation of the Qiusheng double case is the result of the cooperation between the judicial authorities of Hunan Province and the environmental protection department. The police have identified four levels of the industry chain, but due to various factors, the case has not been thoroughly understood.
It took two days to finish
On April 7, 2016, after receiving a report and rushed to Qiusheng's double home, Xu Shuli, director of the Emergency Center of the Environmental Protection Bureau of Miluo City, was shocked by the sight:

Xu Shuli said that the medical waste seized at the Qiusheng double home totaled 52 tons, and it took more than forty vehicles. It took two days to finish.
In Hunan Minlu, the plastic waste recycling industry has a history of more than 30 years. The local area first called it “picking goods†and tens of thousands of people make a living. Located in the new town, the “Tuanshan Renewable Resources Trading Market†(hereinafter referred to as “Tuanshan Marketâ€) was once the largest distribution center for waste plastics in the five provinces of Central and South China.
Beginning in the first half of 2015, Qiu Shengshuang, a villager from Yangliu Village, Gupai Town, Miluo City, frequently appeared here. He came to seek a special kind of goods – the infusion bag in the hospital, which is commonly referred to as “saline bag†in the industry. As the first infusion country, China's annual medical infusions are as many as 10 billion bottles (bags). The outer packaging of these infusion products is made of high-quality polyethylene and polypropylene materials, which is very competitive in the recycled plastics industry.
A year ago, when 26-year-old Qiu Shengshuang took over the plastic crushing business from his father, the original plastic film was purchased from the Tuanshan market three kilometers away. He was pulled home and machined and broken, and then sold to the next home.
However, due to the market downturn in recent years, Qiu Shengshuang’s business is not good. Like many local workshop owners, he had to consider transformation.
At this time, 1300 kilometers away, Gao Xuedong, who is one year younger than Qiu Xiao, is looking for a suitable business partner. His hometown of Wen'an County, Hebei Province, is a famous plastic pellet market in the country. The locals crushed the waste plastics and processed them into pellets, which were sold as raw materials to plastics manufacturers all over the country. Among the recovered waste plastics, medical waste such as infusion bags is included.
Wu Min, the head of the Qiusheng Double Case Task Force and the instructor of the Public Security Bureau of the Miluo City Public Security Bureau, said that in this industrial chain, fragmentation is the most serious part of pollution, and the local groundwater can not be drunk.
Wu Min said that due to the proximity to Beijing, the local environmental remediation was particularly powerful, and all the lowest-end links were expelled. "Allow trading, crushing and processing can't be done." As a result, some workshop owners engaged in the medical waste business had to transfer the primary processing base.
According to Qiu Zhengyu, deputy detachment leader of the Investigation and Detachment of the Public Security Department of the Hunan Provincial Public Security Bureau, after the investigation of the Qiusheng double case, the Provincial Public Security Department and the Provincial Environmental Protection Department attached great importance and immediately deployed special strikes and investigations throughout the province. Up to now, the province has seized 7 cases of illegal disposal of medical waste.
Judging from the cases investigated, Hunan is at the low end of the industrial chain. After the initial processing of medical waste sorting, it flows to the provinces and cities. Currently, Hebei and Zhejiang are identified.
Qiu Shengshuang and Gao Xuedong introduced each other through a middleman. Until the 8th interrogation, Qiu Shengshuang gave Gao Xuedong. After the court found that in addition to the 52 tons seized on the spot, in a short period of six months, Qiu Sheng double sold 140 tons of medical waste to Gao Xuedong.
Gao Xuedong first bought less than one ton of infusion bag crushed material from Qiu Sheng Shuang, and sold it directly to Shamou in Hejian County, Cangzhou City, to make plastic granules. “Sha Moumou infused the infusion bag material into blue propylene PP granules. After the successful trial, in mid-August 2016, Gao Xuedong gave a total of 17 tons of cigarettes from Hunan at a price of 5,200 yuan a ton. According to Gao Xuedong's confession, in addition to Sha Moumou, the goods he entered from Qiu Sheng double were sold to at least three people, earning 400 yuan to 600 yuan per ton.
